Purpose and Request:

The purpose of this report is to request the Board approve the easement agreement and accept and authorize the Chair to execute the agreement conveying a drainage easement granted to Arapahoe County by the City and County of Denver for recordation.
Staff has reviewed the drainage easement and has determined that it meets the County’s requirements. Staff recommends said drainage easement be accepted and signed by the Arapahoe County Board of County Commissioners and the City and County of Denver.

Background and Discussion: The Cherry Creek Corridor Improvement Project between Quebec and Iliff was initiated by a large Stakeholder team including Arapahoe County Open Space, City and County of Denver, Mile High Flood District, the Southeast Metro Stormwater Authority, and Denver Water. The project is proposing construction of stream restoration and recreational improvements for a one-mile reach of Cherry Creek, and will significantly raise the degraded channel invert. As part of the improvements, two Arapahoe County storm sewer outfalls were modified to accommodate the raised channel invert, a new secondary trail system, and to consolidate existing outfalls. Though both outfalls are owned and maintained by Arapahoe County, one of the outfalls is located within the City and County of Denver.
The outfall within Denver jurisdiction was relocated out of the existing drainage easement, which requires placement of a new drainage easement over the outfall’s new location.
Arapahoe County and Denver Staff have worked to draft the new agreement in coordination with the project manager, Muller Engineering Company.
