Purpose and Request:

The Arapahoe County Community Corrections Board is recommending that the Board of County Commissioners (BoCC) approve a Resolution amending the bylaws of the Arapahoe County Community Corrections Board (ACCCB). Article V, Section 1 of the bylaws establishes the composition of the ACCCB. Amendments are necessary due to the creation of the 23rd Judicial District.

Background and Discussion: The ACCCB serves the current 18th Judicial District which includes Arapahoe, Douglas, Elbert and Lincoln counties. Per HB20-1026 and effective January 7, 2025, Douglas, Elbert and Lincoln counties will move from the 18th Judicial District to a newly created 23rd Judicial District. Per Article V, Section 1 of the bylaws, the composition of the ACCCB includes the Douglas County Sheriff as one of eleven (11) agencies serving on the board. With Douglas County joining the 23rd Judicial District, there will no longer be a need to have representation from the Douglas County Sheriff’s Office.
The ACCCB is recommending that the Douglas County Sheriff position be replaced with a seat dedicated to a person with lived experience. The ACCCB is supportive of having more than one person with lived experience on the board at any given time. The ACCCB believes that it is important to dedicate a position for a person with lived experience to ensure that there is always at least one represented on the Board.
Article V, Section 1 allows the BoCC to appoint up to nine (9) citizen members. Although not currently codified in the bylaws, citizen members have historically been citizens of Arapahoe, Douglas, Elbert or Lincoln County. With Douglas, Elbert and Lincoln counties leaving the 18th Judicial District, the ACCCB is recommending Article V, Section 1 of the bylaws be amended to include the following: “Citizen members shall be residents of Arapahoe County while serving on the board. The citizen membership shall be reflective of the County’s diverse community and, at the discretion of the Board of County Commissioners, may include persons with lived experience, including but not limited to, formerly incarcerated individuals, victims or victim advocates, individuals in recovery, current or former behavioral health or criminal justice professionals, business and community leaders.”
Fiscal Impact: There is no fiscal impact to amending the bylaws.
Alternatives: The BoCC has the authority to amend bylaws of the ACCCB at its discretion.

Staff Recommendation: Staff recommend the BoCC pass a resolution amending Article V, Section 1 of the bylaws of the ACCCB as outlined in the board summary report.
Concurrence: The ACCCB approved these recommendations at its September 29, 2024, full board meeting.
