The City of Centennial is processing a site plan and final plat for property within their jurisdiction and has asked Arapahoe County to quitclaim any and all interest the County has therein, as conveyed to the County in a warranty deed/right of way dedication on August 29, 2000. Staff is seeking Board approval of a resolution to quitclaim the County’s interest in that property to Centennial.

Background and Discussion: On August 29, 2000, Frehawk LLC provided a warranty deed conveying interest in certain real property along E Fremont Avenue to Arapahoe County. On December 9, 2013, Centennial annexed the area, including the associated right-of-way. When an area is annexed, interest in right-of-way dedicated by subdivision plat is automatically transferred to the annexing jurisdiction. If a right-of-way was created by a separate instrument, interest in that right-of-way remains with the original grantee. This is the case for the interest previously conveyed to the County along E Fremont Avenue. Centennial is processing a final plat to combine two lots located at 14159 E Fremont Ave and has asked Arapahoe County to quitclaim any and all interest it has therein to Centennial.
Alternatives: Arapahoe County could decline to quitclaim its interests to Centennial; however, there are no benefits to keeping interest in the annexed area. The Board has several options:
1 - Approve the resolution to quitclaim the any and all interest in the property to Centennial,
2 - Deny the resolution, or
3 - Continue this item to a future meeting.
