The BOCC is requested to adopt a Resolution to approve a revised version of the Intergovernmental Agreement with the Town of Foxfield to provide for minor maintenance of Arapahoe Road within the Town’s jurisdiction.

Background and Discussion: On October 25, 2022, the BOCC approved an intergovernmental agreement (IGA) with the Town of Foxfield, whereby the County would perform certain identified minor road maintenance items for Arapahoe Road where the road runs through the jurisdiction of the Town. The Town, however, prior to approving the IGA, pointed out that there was a discrepancy between the language in the IGA and the Exhibit A to the IGA that identified the segment of Arapahoe Road that was covered in the IGA. The IGA, as originally approved by the BOCC, intended all lanes of Arapahoe Road within the Town limits from Parker Road to the Town’s eastern boundary as was shown on the Exhibit A to that IGA. This language discrepancy was corrected in the attached version of the IGA which is being submitted for the Board’s re-approval.  There are no other changes in the IGA from what the BOCC approved on October 25, 2022 and this version. The revised IGA retains the same agreements for description of the covered minor maintenance activities, retains the same County rights to claim the HUTF funds for the segment of road and a proportionate share of SB21-260 fees, and retains access control for the segment of road within the Town.

 

Alternatives: The Board could rescind its prior approval and decline to approve this version, leaving the Town to maintain Arapahoe Road with its resources.  

 

Fiscal Impact: The fiscal impact from the original IGA as approved on October 25, 2022 is unchanged by this revised version of the IGA.
