Jeffrey Erb, Erb Law, LLC, requests the Board of County Commissioners set a public hearing date of February 11, 2025, for consideration of the SD24-002 Eastgate Special District Service Plan. Planning staff recommends approval of this request, which complies with the statutory process for metropolitan district service plans.

Background and Discussion: Colorado Statute CRS 32-1-202(1)(a) outlines the process for reviewing and approving metropolitan district service plans. After a service plan has been filed with the County Clerk and Recorder, the Planning Commission must make a recommendation regarding the plan within 30 days. At the first BOCC meeting that is at least ten days after the Planning Commission action, the BOCC must set a public hearing date for BOCC review of the service plan. This statute also requires that the public hearing be set for a date within 30 days of the date of this meeting on this agenda item.
On December 17, 2024, the Arapahoe County Planning Commission voted to recommend approval of the Eastgate Special District Service Plan. Staff has reviewed the SD24-002 application and finds it is ready for the Board of County Commissioners consideration at a public hearing. Staff concurs with the applicant’s request to set a hearing date for February 11, 2025. This will assist the applicant in coordinating public hearings for the associated General Development Plan (GDP23-003) and 1041 (Regulations Governing Areas and Activities of State Interest) application for extension of domestic water and sewage treatment systems (Case No. ASI24-001).
Alternatives: The Board of County Commissioners is required by CRS 32-1-202 to set a hearing date within 30 days. Accordingly, alternatives are limited to: 1. Approve the request for a February 11, 2025 hearing; or 2. Set a different hearing date within the next 30 days.
Due to the statutory requirements for service plans and material amendments to service plans for special districts, denying or continuing the request are not available options.

Concurrence: On December 17, 2024, Planning Commission voted to recommend approval of the service plan to the Board of County Commissioners. The proposed service plan has been reviewed by County staff, including the County Attorney’s office.
