Correction Resolution for Inverness Drive West bike Path Project Property Acquisitions

Purpose and Request:

This is to request approval of a Resolution directing the Clerk and Recorder to correct Resolutions #22-300A, 22-300B,22-300C, 22-300D, 22-300E, 22-300F,22-300G, 22-300H,22-300I, and 22-300J, which Resolutions approved and accepted various right of way and permanent easement properties for purposes of a Road improvement and Bike Path project for Inverness Drive West.

Background and Discussion: Resolutions Nos. 22-300A-J were adopted on the consent agenda at the November 8, 2022 BOCC business meeting. The Resolutions each accepted and approved the various easement and ROW acquisitions that are needed for the project, but failed to authorize the Public Works Director to execute various easement agreements and other documents required to be executed at closing to complete the transactions. This correction Resolution will direct the Clerk and Recorder to correct Resolutions Nos. 22-300A, 22-300B, 22-300C, 22-300D, 22-300E, 22-300F, 22-300G, 22-300H, 22-300I, and 22-300J, by adding the following statement and authorization to each of the Resolutions:   “The Director of the Arapahoe County Public Works and Development is hereby authorized to execute such documents, including permanent and temporary easement agreements, as are necessary to close on and acquire for the County the property interests described in this Resolution.”  The original Resolutions inadvertently omitted this authorization language and staff needs to have such included to complete the closings for the real property interests required for the Inverness Drive West Bike Path project.

 

Alternatives: This correction resolution is the best alternative for including authority to execute closing documents for the property interests needed for the road project.  

 

Fiscal Impact: There are no additional fiscal impacts from approval of this correction resolution.
