The Sheriff’s Office requests the Board of County Commissioners authorize the Chair of the Board of County Commissioners to sign the 2024 Equitable Sharing Agreement and Certification Report.

Background and Discussion: The Equitable sharing program is a United States program in which the proceeds of liquidated seized assets from asset forfeiture are shared between state and federal law enforcement authorities.  The 2024 Equitable Sharing Agreement and Certification Report must be signed and submitted within 60 days of the end of the Agency’s fiscal year. The approval of this request will allow ACSO to improve customer service and safety.  Under the Federal Equitable Sharing Agreement (ESAC), the Federal Government, Arapahoe County and the Board of County Commissioners are entered in the agreement that sets forth the requirements for participation in the Federal Equitable Sharing Program and the restrictions upon the use of federally forfeited funds property, and any interest earned thereon, which are equitably shared with participating law enforcement agencies.  By submitting this form, Arapahoe County agrees that it will be bound by the Guide and all subsequent updates, this Equitable Sharing Agreement and applicable sections for the Code of Federal Regulations.  Submission of the ESAC is a prerequisite to receiving funds or property through the Equitable Sharing Program. 

 

Alternatives: The alternative is not to sign the 2024 Equitable Sharing Agreement and Certification Report and not receive funds and property though the Equitable Sharing Program. 

 

Fiscal Impact: There is no fiscal impact.
