Purpose and Request:

The Arapahoe County Public Airport Authority Board (ACPAA) intends to change the designated land use of Parcel 61 from aeronautical to non-aeronautical land use. We are requesting to move this item forward to the consent agenda for formal approval of the release of aeronautical restriction on Parcel 61 and for the County Sponsor to sign the release via DocuSign upon receipt.

Background and Discussion:
Parcel 61 is located Northeast of Runway 28 and directly east of the existing go-kart track. It lies inside Parcel 16 on the Airport Layout Plan. The intended use of Parcel 61 consists of parking and an entrance to the existing go-kart track.
It is not feasible to develop this parcel for aeronautical use due to its location, topography, and distance from the airfield. Because the ground was originally purchased with AIP funds, a release from the aeronautical restriction must be formally requested from and approved by the FAA.
On June 13, 2024, the Airport Board of Commissioners provided approval for the Airport to make a formal request to release the aeronautical restrictions on the parcel so it could be developed for non-aviation uses. The Federal Aviation Administration (FAA) has approved the proposed non-aeronautical use of the property. On October 10, 2024, the Airport Board of Commissioners approved the release of the aeronautical restriction, pending the terms of the “Non-Aeronautical Land Use Approval” are satisfactory and accepted by the Sponsor.
Fiscal Impact: The release would result in increased revenue for the Airport associated with a land lease.
Alternatives: The Board could elect not to release the property from aeronautical restrictions. However, should the property not be released, a viable tenant for the go kart track may be difficult to secure and/or retain.

Staff Recommendation: Airport staff recommends moving the release of the aeronautical restriction on Parcel 61 forward to the consent agenda for formal approval and for the Sponsor to sign the release via DocuSign upon receipt.
Concurrence: Federal Aviation Administration and the Airport Board of Commissioners concur with this proposal.
