Adoption of a resolution to approve the application for a change of location of the local Retail Marijuana Store License filed by Colorado Compassionate Care Givers, Inc. dba Rocky Mountain High located at 3431 South Federal Boulevard, Unit G, Englewood, CO 80110, and to issue the Retail Marijuana Store License to Colorado Compassionate Care Givers Inc. dba Rocky Mountain High pursuant to the Arapahoe County Commercial Marijuana Store Licensing Policy (the “Policy”), to be valid from April 29, 2024 through April 28, 2025, and authorizing the Chair of the Board of County Commissioners to sign the local license, subject to the condition that no local license will issue until applicant presents a certificate of occupancy for the premises location duly issued by and of record with the Arapahoe County Building Division, Department of Public Works.

Background and Discussion: On December 3, 2024, pursuant to the Policy, Colorado Compassionate Care Givers, Inc. dba Rocky Mountain High filed with the County an application for a change of location of the Retail Marijuana Store License to Colorado Compassionate Care Givers Inc. dba Rocky Mountain High for the premises located at 3431 S. Federal Blvd., Unit G, Englewood, CO 80110 to 3431 S. Federal Blvd., Unit A, Englewood, CO 80110
Prior to submission of this application, as provided in the Policy, Colorado Compassionate Care Givers, Inc. dba Rocky Mountain High also applied to the State of Colorado, Department of Revenue, for a change of location to Colorado Compassionate Care Givers Inc. dba Rocky Mountain High of the Retail Marijuana Store License to operate a Retail marijuana store at the address.
The County received and reviewed the State application for a change of location of the Retail Marijuana Store License filed by Colorado Compassionate Care Givers, Inc. dba Rocky Mountain High for the premises located at 3431 S. Federal Blvd., Unit G, Englewood, CO 80110.
The Retail Marijuana Store License shall be valid only if the application for a change of location is approved by the State Licensing Authority and a new Retail Marijuana Store License is issued by the State to Colorado to Compassionate Care Givers Inc. dba Rocky Mountain High for the premises located at 3431 S. Federal Blvd., Unit A, Englewood, CO 80110, subject to the condition that no local license will issue until applicant presents a certificate of occupancy for the premises location duly issued by and of record with the Arapahoe County Building Division, Department of Public Works.
On December 11, 2024, the Arapahoe County Zoning Department confirmed that the location has been in compliance with the Arapahoe County Land Development Code Regulations. On December 11, 2024, the Arapahoe County Sheriff’s Office provided that there were no material issues or concerns with the location.
The application for a change of location of the Retail Marijuana Store License for Colorado Compassionate Care Givers, Inc. dba Rocky Mountain High to Colorado Compassionate Care Givers Inc. dba Rocky Mountain High is located at 3431 S. Federal Blvd., Unit A, Englewood, CO 80110 is in compliance with the requirements of the Policy and the Land Development Code. All fees for the application have been paid.
The Policy provides that, if approved, an application for a change of location and issuance of a Retail Marijuana Store License shall be valid for the period corresponding with that specified in the approved State of Colorado Retail Marijuana Store License.
Pursuant to the Policy, the application for a change of location and issuance of a Retail Marijuana Store License of Colorado Compassionate Care Givers, Inc. dba Rocky Mountain High to Colorado Compassionate Care Givers Inc. dba Rocky Mountain High is being placed on the BOCC consent agenda for approval.
Alternatives: The Board may deny the application for a change of location and issuance of the Retail Marijuana Store License for this property upon a finding that the proposed application does not comply with a particular requirement of the Policy or Section 3-3.5 of the Land Development Code.
Fiscal Impact: Licensing fees will provide revenue to the County to cover the cost of licensing. Otherwise, there is no fiscal impact.
