The purpose of this study session is to update the Board of County Commissioners (BOCC) on community corrections referrals and placements from the 23rd Judicial District (JD) and request to renew the Intergovernmental Agreement (IGA) with the 23rd JD.

Background and Discussion: Community Corrections plays a vital role in diverting individuals from prison and supporting their transition from the Department of Corrections back into the community. The 23rd JD, which includes Douglas, Elbert, and Lincoln Counties, currently does not operate a community corrections program.
On January 28, 2025, the BOCC approved an IGA, Resolution No. 25-065, allowing the Arapahoe County Community Corrections Board (ACCCB) to screen referrals and place individuals from the 23rd JD in community corrections facilities located in Arapahoe County. This agreement was effective for a period of one (1) year from the date of execution.
Between January 7, 2025, and February 28, 2026, the ACCCB received 85 diversion referrals from the 23rd JD. Of these, 69 (81%) were approved and 13 (15%) were denied. A total of 43 unique individuals from the district were placed in community corrections. During the period, 22 residential placements terminated, including 8 successful completions (36%).
There are currently six (6) 23rd JD clients on non-residential status. Of these individuals one resides in Adams County, two in Arapahoe County, one in Douglas, and one in Jefferson County.
The IGA expired on March 3, 2026. The agreement specified that negotiations for any subsequent IGA regarding the referral of individuals from the 23rd JD to community corrections facilities under contract with Arapahoe County must include an update to Arapahoe County on the 23rd JD’s intent and progress toward establishing a community corrections program within its district.
On March 3, 2026, the Douglas County Board of County Commissioners issued a letter to the Arapahoe County Board of County Commissioners stating that the 23rd JD intends to establish its own community corrections program. The letter outlined the progress made toward developing a program within the district and expressed the district’s desire to renew the IGA to allow continued referrals to and placements in community corrections programs in Arapahoe County.
Alternatives: The BOCC can choose not to renew the IGA. The 23rd JD would not have access to community corrections programs in Arapahoe County to meet its immediate community corrections needs.
Fiscal Impact: Douglas County will fund community corrections placement for all individuals approved by the Arapahoe County Community Corrections Board through its contract with the Division of Criminal Justice. Staff intends to negotiate a fee for auditing community corrections program compliance with state standards under the renewed IGA, based on the projected residential population of 23rd JD clients.

Staff Recommendation: Staff recommends that the BOCC approve the renewal of the IGA, with an option to extend the agreement for an additional year.
