Purpose and Request:

Adoption of a resolution for a change of ownership of the retail marijuana facility from KTA, LLC dba The Lodge to TKOVR, LLC dba Snaxland located at 6200 E. Yale Avenue, Unit B, Denver, CO 80222, authorization of a new Retail Marijuana Store License pursuant to the Arapahoe County Commercial Marijuana Store Licensing Policy (the “Policy”) to be valid for a term that mirrors the dates approved by the State Licensing Authority, and authorizing the Chair of the Board of County Commissioners to sign the local license.  The Department of Revenue requires the local jurisdiction to grant the new license due to the change of ownership prior to the State of Colorado issuing its Retail Marijuana Facility State License.

Background and Discussion: On January 5, 2021, pursuant to the Policy, the BOCC approved and issued a Retail Marijuana Store License for KTA, LLC dba The Lodge. The license was previously renewed annually with the most recent renewal on January 9, 2024, with an expiration date of December 28, 2024.

 

On April 29, 2024, pursuant to the Policy, TKOVR, LLC dba Snaxland filed with the County an application for transfer of ownership and an application for a new Retail Marijuana Store License for the licensed premises located at 6200 E. Yale Avenue, Unit B, Denver, CO 80222.


Prior to submission of these application, as provided in the Policy, TKOVR, LLC dba Snaxland also applied to the State of Colorado, Department of Revenue, for the transfer of ownership of a Retail Marijuana Store License to operate a retail marijuana store at the address.

The County received and reviewed the State application for change of ownership for the Retail Marijuana Store License. TKOVR, LLC dba Snaxland will continue to operate this business under the new name.

 

The Retail Marijuana Store License shall be valid only if the transfer of ownership is also approved by the State Licensing Authority.

The Arapahoe County Zoning Department previously confirmed that the location has been in compliance with the Arapahoe County Land Development Code Regulations. The Arapahoe County Sheriff’s Office previously provided that there were no material issues or concerns with the location.

 

The applications for transfer of ownership and a new Retail Marijuana Store License for TKOVR, LLC dba Snaxland for the premises located at 6200 E. Yale Avenue, Unit B, Denver, CO 80222 are in compliance with the requirements of the Policy and the Land Development Code. All fees for the applications have been paid.

 

The Policy provides that, if approved, a transfer of ownership and a new Retail Marijuana Store License “will be issued for a period of one (1) year and mirror the expiration date of the State License, which is conditioned upon approval of a corresponding State License before it becomes effective.”

 

Pursuant to the Policy, change of ownership and issuance of a new Retail Marijuana Store License for TKOVR, LLC dba Snaxland is being placed on the BOCC consent agenda for approval.

 

Alternatives: The Board may deny the applications for the transfer of ownership and a new Retail Marijuana Store License for this property upon a finding that the proposed applications do not comply with a particular requirement of the Policy or Section 3-3.5 of the Land Development Code.    

 

Fiscal Impact: Licensing fees will provide revenue to the County to cover the cost of licensing. Otherwise, there is no fiscal impact.
