Purpose and Request:

The purpose of this report is to address the disposition of Right-of-Way (ROW) to close out the Iliff Operational Improvement Project (Iliff).  Specifically, this request is for authorization to donate ROW purchased for the Iliff project to the Colorado Department of Transportation (CDOT) and authorization for the Director of Public Works and Development to sign CDOT donation forms.

Alignment with Strategic Plan:  Good Governance - Plan for future service, infrastructure, and fiscal needs. The action supports the Good Governance factor by making certain that the County effectively manages existing resources and when appropriate, disposes of certain assets (in this case) to another public asset inventory.

 

Background and Discussion: Arapahoe County purchased the parcels shown below for the construction of the Iliff Operational Improvement Project along Parker Road near the intersection with Iliff Avenue. Each of the parcels was constructed to accommodate the right turn lane widening from southbound Parker to westbound Iliff.  As the Local Public Agency for the project, Arapahoe County was required to purchase the properties for construction.  These parcels are adjacent to CDOT ROW and are part of the Parker Road corridor.  The Parker Road corridor and associated ROW are currently maintained by CDOT.  These parcels should be donated to CDOT for perpetual maintenance and operations.  CDOT procedures allow for this transfer of property particularly in instances where transportation related improvements are constructed therein.  In this case the physical improvements included sidewalk, curb and gutter, and asphalt pavements. Staff reviewed the legal description for these parcels were consistent with the parcels that were originally purchased for the project. CDOT provided procedural instructions by which this donation to CDOT will occur.  As a result of this transfer, the maintenance of these parcels will move from the County to CDOT. 

 

This action donates selected ROW parcels to the Colorado Department of Transportation (CDOT).  This donation action is in accordance with CDOT policy and procedure regarding the acceptance of property that may have previously been used to construct transportation facilities. The easement is proposed as a “no-cost” action as the agreement will be between 2 governmental entities.

 

Alternatives: The alternative is for the County not to donate the property to CDOT and maintain the property in the future. 

 

 Fiscal Impact: There is no fiscal impact to the County except in a decrease in the property asset value associated with the property donation. 

 

Alignment with Strategic Implementation Strategies: N/A

 

Concurrence: Road and Bridge and County Attorney’s office have no objections to removing these properties from the County’s maintenance.
