Purpose and Request:

Adoption of a resolution to approve the application for a renewal of the local Retail Marijuana Store License filed by NuVue Pharma, LLC located at 1842 S. Parker Rd., #18, Denver, CO 80231, pursuant to the Arapahoe County Commercial Marijuana Store Licensing Policy (the “Policy”), to be valid from December 24, 2024 through December 23, 2025 and authorizing the Chair of the Board of County Commissioners to sign the local license. The Department of Revenue requires the local jurisdiction to grant a renewal license prior to the State of Colorado issuing its renewed State Retail Marijuana Store License.

Background and Discussion:

On December 8, 2020, pursuant to the Policy, the BOCC approved and issued a Retail Marijuana Store License for the previous owner of the Retail marijuana store located at 1842 S. Parker Rd., #18, Denver, CO 80231, which was renewed annually.

 

On February 22, 2022, pursuant to the Policy, the BoCC approved the application for transfer of ownership of a Retail Marijuana Store License to NuVue Pharma, LLC of the licensed premises located at 1842 S. Parker Rd., #18, Denver, CO 80231 and on April 18, 2022 issued a New Retail Marijuana Store License. The license was previously renewed annually with the most recent renewal on November 14, 2023 with an expiration date of December 23, 2024.

 

On October 29, 2024, pursuant to the Policy, NuVue Pharma, LLC filed with the County an application for a renewal of the Retail Marijuana Store License for the premises located at 1842 S. Parker Rd., #18, Denver, CO 80231.

 

Prior to submission of this application, as provided in the Policy, NuVue Pharma, LLC also applied to the State of Colorado, Department of Revenue, for a renewal of the Retail Marijuana Store License to operate a Retail marijuana store at the address.

 

The County received and reviewed the State application for a renewal of the Retail Marijuana Store License filed by NuVue Pharma, LLC for the premises located at 1842 S. Parker Rd., #18, Denver, CO 80231.

 

The Retail Marijuana Store License shall be valid only if the renewal is approved by the State Licensing Authority.

 

On September 18, 2024, the Arapahoe County Department of Public Works and Development confirmed that they have no objection or concerns regarding the application.  On September 24, 2024, the Arapahoe County Sheriff’s Office confirmed that they have no material issues or concerns regarding the application. 

 

The application for a renewal of the Retail Marijuana Store License for NuVue Pharma, LLC located at 1842 S. Parker Rd., #18, Denver, CO 80231 is in compliance with the requirements of the Policy and the Land Development Code. All fees for the application have been paid.

 

The Policy provides that, if approved, a renewal of a Retail Marijuana Store License “will be issued for a period of one (1) year and mirror the expiration date of the State License, which is conditioned upon approval of a corresponding State License before it becomes effective.”

 

Pursuant to the Policy, renewal and issuance of the Retail Marijuana Store License for NuVue Pharma, LLC is being placed on the BOCC consent agenda for approval.

 

Alternatives: The Board may deny the application for a renewal of the Retail Marijuana Store License for this property upon a finding that the proposed application does not comply with a particular requirement of the Policy or Section 3-3.5 of the Land Development Code. 

 

Fiscal Impact: Licensing fees will provide revenue to the County to cover the cost of licensing. Otherwise, there is no fiscal impact.

Concurrence: The Arapahoe County Department of Public Works and Development, and the Arapahoe County Sheriff’s Office have no objection to the application for a renewal of the Retail Marijuana Store License and issuance of the license.
