The Arapahoe County Community Corrections Board (ACCCB) is recommending that the Board of County Commissioners (BoCC) approve a resolution amending the bylaws of the ACCCB.  Amendments are necessary due to the creation of the 23rd Judicial District.

Background and Discussion: The ACCCB serves the current 18th Judicial District which includes Arapahoe, Douglas, Elbert and Lincoln counties.  Effective January 7, 2025, Douglas, Elbert and Lincoln counties will move from the 18th Judicial District to a newly created 23rd Judicial District.  Per Article V, Section 1 of the bylaws the composition of the ACCCB includes the Douglas County Sheriff as one of eleven (11) agencies serving on the board. With Douglas County joining the 23rd Judicial District there will no longer be a need to have representation from the Douglas County Sheriff’s Office. 

The ACCCB is recommending that the Douglas County Sheriff position be replaced with a seat dedicated to an individual with lived experience and to codify that non-agency members must reside in Arapahoe County to serve on the ACCCB.  At a drop-in session on October 21, 2024, the BoCC approved amending the bylaws to remove the Douglas County Sheriff position, replace the term “citizen” in the bylaws with “resident”, codify that non-agency members must reside in Arapahoe County, and dedicate at least one (1) resident position to a person with lived experience.  As a result of the amendments the number of agency representatives on the board is reduced to ten (10). 

Article V, Section 1 allows the BoCC to appoint up to nine (9) other persons.  Article V, Section 1 of the bylaws is amended to: “In addition, up to nine (9) other persons may also be appointed to serve on the Board as resident members.  Resident members shall reside in Arapahoe County while serving on the board.  The resident membership shall include at least one (1) person with lived experience and be reflective of the County’s diverse community. At the discretion of the Board of County Commissioners, the resident membership may include persons with lived experience, including but not limited to, formerly incarcerated individuals, victims or victim advocates, individuals in recovery, current or former behavioral health or criminal justice professionals, business and community leaders.” 

The second sentence of Article V, Section 3 is amended to: “Resident members shall be eligible to service three (3) consecutive three (3) year terms.  The third sentence of Article V, Section 3 is amended to: “The Arapahoe County Board of County Commissioners may choose to extend term limits of resident members”. 

At the drop-in session on October 21, 2024 the BoCC approved adding the amendments to the ACCCB bylaws to the consent agenda. The amended bylaws of the ACCC shall go into effect January 7, 2025.

 

Alternatives: The BoCC has the authority to amend the bylaws of the ACCCB at its discretion. 

 

Fiscal Impact: There is no fiscal impact to amending the bylaws.
