Background and Discussion: Opioids settlements have been reached nationwide with the “Big 3” opioid distributors (McKesson, Cardinal Health, and AmerisourceBergen) and Johnson & Johnson to resolve claims by state and local governments that these companies contributed to the opioid epidemic. In 2021, the State of Colorado and Participating Local Governments executed the Colorado Opioids Summary Memorandum of Understanding (MOU) that established the manner in which opioid funds were to be divided and distributed within the State of Colorado. The Board approved this MOU at their meeting on Oct. 26, 2021.
On May 24, 2022, the Board of County Commissioners (BOCC) approved entering into an IGA with its participating municipalities to form a Regional Opioid Council for Region 9 (Regional Council), which encompasses the entirety of Arapahoe County. This IGA establishes the composition of the regional council and governance structure. Per the requirements of the Colorado MOU, this council will develop a two-year plan that identifies how the Opioid Funds will be used and manage the distribution of funds in support of this plan. The IGA also designated Arapahoe County as the fiscal agent for receipt and distribution of these funds on behalf of the regional council.
Per the IGA, the BOCC is responsible for appointing the following members to the Regional Council:
• Two (2) representatives appointed by the Arapahoe County Board of County Commissioners and alternates
• 1 representative appointed from the County Court system or District Attorney’s Office or their designee
Pursuant to the Intergovernmental Agreement - Opioid Abatement, members will serve two-year terms unless they resign or are otherwise removed by the Board of County Commissioners. The Board may remove and reassign members at any point.
The Board of County Commissioners appointed two representatives at their meeting on January 14, 2025. This resolution will appoint the representative from the County Court system or District Attorney’s Office.
Alternatives: The BOCC could choose not to appoint this representative or to adjust their appointments. However, this may impact the scheduling for the Regional Council and the receipt of funding associated with this process.
Fiscal Impact: There is no fiscal impact to making these appointments.
Alignment with Strategic Plan:
☐Be fiscally sustainable
☐Provide essential and mandated service
☒Be community focused
Concurrence: This has been coordinated in concurrence with the County Attorney’s Office, County Courts and District Attorney’s Office.
Resolution: Attached is a copy of the draft resolution.
