Purpose and Request:

recommended action

Request the Board of County Commissioners (BOCC) to authorize the Chair to sign the Third Amended and Restated Intergovernmental Agreement for Secure Transportation Licensing and Inspection (IGA) between multiple agencies to be part of the secure transportation inspection and licensing process; authorize Nathan Fogg, Director, Arapahoe County Office of Emergency Management, to complete all required forms with the Colorado Department of Public Health and the Environment on behalf of Arapahoe County opting out of issuing local authorization to operate for ground ambulance services; and rescind Resolution No. 1415-96, governing ambulance licensing by Arapahoe County

end

Background and Discussion: Arapahoe County has been part of this ambulance licensing process with several regional counties (Adams, Arapahoe, Broomfield, Denver, Douglas, Elbert, and Jefferson) since February 5, 1991, based on the adoption of regulations and Resolution No. 163-91 and revised and restated Resolution No. 1415-96. In 2009, Denver County withdrew from this IGA. The original membership counties developed a streamlined process for the ambulance companies to apply for licensing. The process involves using a standardized application, vehicle (unit) inspection form, equipment inventory form, insurance requirements, and proof of training and education.  The process ensures consistency among each of the participating counties and allowed certified operators to operate in all the participating counties without requiring a separate licensing process for each county. In 2023, the IGA was amended to include similar processes for licensing and inspecting secure transportation services. Effective July 1, 2024, the Colorado Department of Public Health and Environment took over managing ambulance inspections statewide. On June 27, 2024, the participants to the IGA voted to dissolve the Ambulance Inspection and Licensing Program committee and remove ambulance licensing from the current intergovernmental agreement, leaving the IGA in place for secure transportation inspection and licensing. Accordingly, the IGA has been amended and restated to reflect those changes.

Alternatives: If not signed, Arapahoe County would be required to either contract or hire staff with the expertise to set up and run its own process for licensing and inspecting secure transportation services in compliance with state law and CDPHE regulations.

Fiscal Impact: Neutral. Costs of inspection and licensing are born by the applicants, paid with the submission of the application.

Alignment with Strategic Plan:

                     Be fiscally sustainable

                     Provide essential and mandated service

                     Be community focused

Concurrence: Tyler S. Brown, Sheriff; Kenneth McKlem, Bureau Chief; Adam Burson, Captain; Olga Fujaros, Sheriff’s Finance Manager; Jefferson County Public Health (IGA Administrator) and IGA Multi-County Ambulance Licensing Committee.
