Purpose and Request:

recommended action

The purpose of this item is to hold a public hearing on and consider adoption of the proposed Arapahoe County Ordinance No. 2024-02, establishing comprehensive vehicle parking regulations applicable on Couty roads and highways and on other County owned properties.  This is the second step in the required statutory process for a county to adopt the ordinance.

Background and Discussion: The proposed Ordinance No. 2024-02 is presented for a public hearing in conformance with statutory requirements.  The first reading of proposed Ordinance was held on September 24, 2024, at which the Board approved moving the Ordinance along for public hearing on October 22, 2024.  The Ordinance was published as read in the Colorado Community Media newspapers, newspapers of general circulation in the county on October 10, 2024. If the Board approves the Ordinance No. 2024-02 following the public hearing, the last step will be to publish the ordinance by Title and, if the Ordinance is amended following the initial publication, the publication shall also publish the full text of the amended provisions.

The Ordinance establishes comprehensive regulations for the parking of vehicles on County roads and highways, including sidewalks and other right of way areas, and on other county owned properties such as, but not limited to, County Open Spaces properties and parks, that are located within unincorporated Arapahoe County; and establishes a $150 citation for violation of the Ordinance.  Further and more detailed description of the background for the Ordinance and parking restrictions that it would impose are set forth the Board Summary Report submitted with the First Reading Agenda Item.

After the first reading and with the publication of the Ordinance, based on comments received and further staff review, certain amendments to the Ordinance are proposed for the Board’s consideration and inclusion.

If the Board decides to adopt Ordinance No. 2024-02 it is recommended that Board approve the inclusion of the following amendments to the text of the Ordinance from what read at the First Reading and published on October 10, 2024:

1.                     Amending Section I.5 to revise the definition of abandoned vehicle to limit to motor vehicles or and to include abandoned trailers. This more conforms with the statutory definition of CRS. 42-4-1801.

2.                     Amending Section I.5 to add a definition for “bicycle lane” and amending Section II.4 to prohibit parking in a bicycle lane.

3.                     Amending the definition of “parking control device” in Section I.5 to include a “parking meter or other similar device requiring advance payment for parking.”

4.                     Amending Section II.9. to remove the reference to the Denver Regional Council of Governments area boundary and make the parking restriction for oversized commercial vehicles apply Countywide in the unincorporated County.

5.                     Amending the definition of inoperable vehicles in Section I.5 to exclude unregistered vehicles from the definition and to include inoperable trailers.

6.                     Amending Section II.8. to add new sub-section (c) to make it a violation under the Ordinance to park or store an unregistered motor vehicle or tailer on a County highway or road or on County owned property, and adding definition of current registration.

7.                     Amending Section III.2.a.4 to clarify that only abandoned motor vehicles or trailers may be towed under this sub-section. This deletes inoperable vehicles as originally defined from the Section with the effect that inoperable or unregistered motor vehicles or trailers may be towed if they meet the definition of having been abandoned or may be towed under other provision of the Ordinance or State law.

Fiscal Impact: While paid fines will provide a source of revenue, enforcement will take staff and resources which will have some fiscal impact.

Alternatives: The Board has the following options:

1.                     Adopt Ordinance No. 2024-02 with the above amendments.

2.                     Adopt Ordinance No. 2024-02 as published on October 10, 2024.

3.                     Deny adoption of Ordinance No. 2024-02.

4.                     Continue the hearing to a time and date with direction to staff on further or other amendments to the Ordinance.

Alignment with Strategic Plan:

                     ☒Be fiscally sustainable

                     ☒Provide essential and mandated service

                     ☒Be community focused
