Purpose and Request:

The purpose of this study session is to seek Board input on any legislative priorities they would like to propose to Colorado Counties, Inc. (CCI) for the 2023 legislative session.

Background and Discussion: Each year, CCI solicits legislative priority ideas from member counties. They will adopt 6 - 8 ideas and work with legislators to run bills in alignment with these priorities. CCI is interested in legislation that applies to most or all of the counties in the state. These are separate from the Arapahoe County legislative priorities that will be discussed at a later date.

CCI is seeking ideas for legislation that:

                     Addresses existing inefficiencies; and/or

                     Launches new programs/tools counties can used to address the needs of their communities; and/or

                     Revises existing laws to better reflect implementation realities.

 

The purpose of this study session is to seek ideas from the Board for legislative priorities they would like to propose to CCI. CCI is holding a meeting on July 15, 2022 to have a preliminary discussion about ideas submitted from member counties and will finalize them at a Legislative Committee Meeting in October. 


Through E-Team, Public Works & Development (PWD) suggested one priority idea: a utility relocation delay penalty bill. Utility companies are not always meeting agreed upon timelines or responding to inquiries for utility relocations during construction projects. When these do not occur in a timely manner, construction timelines have to extend, thus increasing costs for local governments. PWD is suggesting a bill that establishes a legislative action to hold utility companies accountable for honoring timelines and/or bearing the responsibility for increased costs to local governments due to utility relocation delays.

Alternatives: The Board can revise the E-Team recommendation, submit their own priority idea(s), or decide to not submit any legislative priority ideas for the 2023 session.

Staff Recommendation: PWD suggests proposing the utility relocation delay penalty bill idea to CCI.
