Adoption of a resolution confirming that the Open Spaces Director, past and present, has had, and continues to have, authority to execute grant agreements for grants approved by the Board of County Commissioners (after receiving recommendations from the Open Space and Trails Advisory Board), to administer the open space grant program, and to extend the timeframe for completion of grant projects and the availability of funds for such projects as needed.

Background and Discussion: Recently, a question was raised concerning the Open Spaces Director’s authority to extend the timeframe for completion of grant projects.
In response to this question, since 2003, Arapahoe County has had a voter-approved open space sales and use tax program that includes a grant component (currently governed by Resolution No. 21-263). The Open Spaces Department has had a longstanding practice, pursuant to authority delegated by the Board of County Commissioners to the Open Spaces Director, to execute grant agreements for grants approved by the Board of County Commissioners (after receiving recommendations from the Open Space and Trails Advisory Board). The Open Spaces Department has also had a longstanding practice, pursuant to authority delegated by the Board of County Commissioners to the Open Spaces Director, to administer the open space grant program and to extend the timeframe for completion of grant projects and the availability of funds for such projects as needed.
By adopting the proposed resolution, the Board formally re-confirms and clarifies that the Open Spaces Director, past and present, has had, and continues to have, authority to execute grant agreements for grants approved by the Board of County Commissioners (after receiving recommendations from the Open Space and Trails Advisory Board), to administer the open space grant program, and to extend the timeframe for completion of grant projects and the availability of funds for such projects as needed, and the Board ratifies such extensions authorized by the Open Spaces Director.
