Purpose and Request:

recommended action

Request the Board of County Commissioners to approve the final set of Exhibits for the 2026 Intergovernmental Agreement between the Arapahoe County and the City of Centennial for Law Enforcement and Public Safety Services.  The Exhibits are comprised of the following: Exhibits A (Services), B (Performance Standards), C (Schedule of Assigned Personnel), D (Schedule of Costs), and E (Risk Sharing Cost Allocation).

Background and Discussion: The City of Centennial contracts with Arapahoe County through an intergovernmental agreement to provide law enforcement services within its municipal boundaries.  The Arapahoe County Sheriff’s Office (ACSO) has provided law enforcement services since the incorporation of the City on February 7, 2001. In October 2017, the City and County mutually-approved a new ten-year Agreement for Law Enforcement Services, which took effect on January 1, 2018. The Agreement was amended on May 7th, 2019 to be effective until December 31, 2021, with an option for a five year renewal term ending December 31, 2027. The Agreement anticipate and specifically set forth that the County would approve a final set of exhibits following the County’s approval of the 2026 Budget.  Therefore, when the Arapahoe County 2026 Budget is adopted, the exhibits are revised to incorporate the adopted and final budget numbers.  The Sheriff’s Office seeks to have the Board approve the final exhibits so they may be transmitted to the City for approval. Based on the current agreement, the Arapahoe County provided the following preliminary exhibits to the City of Centennial: Exhibit A - Law Enforcement Services, Exhibit B - Performance Standards, Exhibit C - Schedule of Assigned Personnel, Exhibit D - Total Annual Fees and Exhibit E - Risk Sharing Cost Allocation

 

Alternatives: The alternative is to not adopt final exhibits.  This will not correspond to the 2026 Adopted Budget, and it will likely implicate provisions in the Agreement requiring that the City and County negotiate in good faith regarding the finalization of the exhibits.

 

Fiscal Impact: The revised 2026 Centennial contract for law enforcement services is $43,180,582.

 

Alignment with Strategic Implementation Strategies: The attached framework helps Arapahoe County institutionalize values-based, transparent decision-making, documenting how we make decisions and carry out actions to achieve the county’s strategic plan.

 

Concurrence: The Sheriff’s Office Administration and Public Safety Bureau are in concurrence with this decision.
