Purpose and Request:
recommended action
At the September 10, 2024, business meeting, the Board of County Commissioners approved an Intergovernmental Agreement (IGA) regarding the South Metro Enterprise Zone with the City of Englewood. It granted signing authority for the IGA to Bryan Weimer, Public Works and Development Director subject to final approval as to form by the County Attorney’s Office. However, the version of the IGA included in the agenda was not the version approved by the County Attorney’s Office and the City of Englewood. The final version of the IGA as approved and also signed by the City of Englewood is attached. A revised resolution approves this version and authorizes Bryan Weimer to sign this version.

Background and Discussion: As described at the September 10, 2024, meeting, the South Metro Enterprise Zone was amended by the Colorado Economic Development Commission to include portions of eastern Arapahoe County. The City of Englewood serves as the South Metro Enterprise Zone Administrator. The IGA describes the roles of the City and County in administering the newly identified subzone of the South Metro Enterprise Zone.
The final version of the IGA contains one major change from the version in the September 10th agenda. Item 3.f.i. has been moved to item 4.d. This item reads, “For the purposes of this agreement, the South Metro EZ Administrator will manage the pre-certification and certification process for the Arapahoe County Subzone” and is more appropriately included under the City responsibilities rather than the County items.
The only other wording change was to the sixth WHEREAS to simplify the language but no change to the intent.
Fiscal Impact: This correction does not affect the fiscal impact.
Alternatives: Approve, modify, or deny the resolution authorizing the signing of the IGA with the City of Englewood. Without the IGA, the businesses and nonprofit entities in the eastern section of the County would have little support in participating in the Enterprise Zone program. County staff would not be authorized to provide assistance, and the City of Englewood does not have the resources to provide administrative functions beyond its current area
Alignment with Strategic Plan:
☒Be fiscally sustainable
☒Provide essential and mandated service
☒Be community focused
Staff Recommendation: Staff recommends that the Board approve the final version of the IGA.
Concurrence: The City of Englewood concurs with this version of the IGA.
Resolution: A draft resolution consistent with the staff recommendation is attached.
