Signing Authority for Closing Documents for High Line Canal Acquisition

Staff requests that the Board of County Commissioners (BOCC) adopt a resolution granting signing authority to the Chair to execute all deeds, assignments, and other documents necessary to close on the acquisition of portions of the High Line Canal. This matter was discussed with the BOCC during a study session regarding the acquisition on April 29, 2024.

Background and Discussion: On November 14, 2023, the Board adopted Resolution No. 23-270 authorizing the Chair to sign the Intergovernmental Agreement for Conveyance of High Line Canal Property between Arapahoe County and the City and County of Denver, acting by and through its Board of Water Commissioners, by which Arapahoe County agreed to take ownership of 45 miles of the 71-mile High Line Canal corridor including sections in Arapahoe, Denver, and Adams Counties.
Closing on the acquisition is scheduled for June 13, 2024. To close, Arapahoe County will be required to execute deeds to receive ownership of the property in the three counties, assignments of numerous encumbrances existing on the property in the three counties, and other associated closing documents. Staff will provide the closing documents to the Chair for execution prior to the closing date.
Alternatives: The BOCC could alternatively grant signing authority to Margina Pingenot, Open Spaces Director.
