The County Attorney’s Office requests that the BOCC adopt a resolution to repeal a number of ordinances that are outdated and no longer necessary or applicable.

Alignment with Strategic Plan: Good Governance - Deliver mandated and essential services with excellence.
Background and Discussion: Pursuant to the authority granted by C.R.S. §§ 30-11-101(2) and C.R.S. § 30-11-401, the BOCC may adopt ordinances for control or licensing of certain matters of local concern. Over time, however, existing ordinances may become unnecessary, outdated, or obsolete due to changed circumstances, the completion of their intended purposes, or redundancy with current laws and regulations. The following Arapahoe County Ordinances are requested to be repealed because they are outdated and no longer necessary: (1) Smoking in Public Places - Ordinance No. 1988-1; (2) Tobacco Possession by Minors - Ordinance No. 2008-01; (3) Christmas Tree Lot Permit System - Ordinance No. 85-1; and (4) Fireworks Stand Permit System - Ordinance No. 86-1.
Alternatives: The BOCC could choose to leave these outdated ordinances in place.

Staff Recommendation: The County Attorney’s Office recommends approval.
Concurrence: Arapahoe County Public Health recommends approval for repeal of the tobacco ordinances.
