Purpose and Request:

recommended action

The purpose of this report is to request that the Board adopt a resolution approving the warranty deed and thereby accepting right-of-way along S Gun Club Rd adjacent to USS Calico and USS Raptor Solar Projects in unincorporated Arapahoe County. It is further requested that the Board authorize the Director of the Department of Public Works and Development to execute the warranty deed on behalf of the Board.

Background and Discussion:

Calico and Raptor Solar projects are adjacent to S Gun Club Rd which is in the jurisdiction of Colorado Department of Transportation. S Gun Club Road borders the City of Aurora and the County of Arapahoe. Additionally, S Gun Club Rd abuts the solar projects and the existing ROW is short of the required ROW recommended in the 2040 Transportation Plan. Due to impacts of the development, the dedication of right-of-way to the County became necessary. The County will hold until such time as it is needed by CDOT for roadway expansion. This dedication was made necessary as part of the approval of these underlying solar projects. This dedication satisfies associated conditions of approval.
