Purpose and Request:

Judicial Services is requesting that the BOCC approve a waiver per the Purchasing Policy for Community Corrections contracts with CoreCivic for Fiscal Year 26-27.

Alignment with Strategic Plan: Safe and Healthy Communities - Advance public safety by strengthening partnerships across law enforcement, emergency response, and community stakeholders.

Background and Discussion: The County publicly solicited for qualified community corrections provider(s) to deliver evidence-based programming to address criminogenic needs, enhance public safety and support client rehabilitation and successful reintegration into the community. Two submissions were received and only one met the minimum to be considered responsive.

The County's largest incumbent, CoreCivic, was aware that the solicitation was underway but failed to submit on time. The company contacted the County immediately after missing the deadline; however, the late submission could not be accepted. CoreCivic submitted the late proposal via email, and it was subsequently deemed acceptable as a necessary continuation of the services currently provided.

Alternatives: If the waiver request is not approved, the County would lose approximately 200 residential beds. The clients currently placed at CoreCivic's two facilities (approximately 150) would be displaced, many of whom would likely be returned to the Department of Corrections or the Arapahoe County Detention Facility.
