Purpose and Request:

The District Attorney’s Office is requesting the Board of County Commissioners authorize the Chair of the Board of County Commissioners to sign the Equitable Sharing Agreement and Certification Report.

Background and Discussion: The Equitable Sharing program is a federal program under the Department of Justice in which the proceeds of liquidated, seized assets from asset forfeitures are shared between state, local, and federal law enforcement.  The Equitable Sharing Agreement and Certification Report must be signed and submitted within 60 days of the agency’s fiscal year.  Under the Federal Equitable Sharing Agreement, the federal government, the District Attorney’s Office, and Arapahoe County are agreeing to the requirements for participation in the Federal Equitable Sharing program and the restrictions upon the use of federally forfeited funds, property, and interest earned thereon, which are equitably shared with participating law enforcement agencies.

 

Alternatives: The alternative would be to not sign this agreement and forego any funds that would be received through this program that have been used in the past by the District Attorney’s Office to offset costs. 

 

Fiscal Impact: The fiscal impact would be equivalent to the amount of forfeited funds that would be shared with the District Attorney’s Office by the federal government, which is not known at this time
