Judicial Services is requesting the Board of County Commissioners approve and authorize the Chair to sign an Intergovernmental Agreement between Arapahoe County, Douglas County, Elbert County and Lincoln County to allow community corrections clients referred by the 23rd Judicial District to be placed in community corrections programs in Arapahoe County.

Background and Discussion: Community corrections plays a vital role in diverting individuals from prison and assisting people in transitioning from the Department of Corrections back to the community. The newly created 23rd Judicial District (JD) comprised of Douglas, Elbert and Lincoln Counties, does not have a community corrections program. Per direction from the Board of County Commissioners (BoCC) on November 19, 2024, Judicial Services, in coordination with the County Attorney's office drafted an Intergovernmental Agreement (IGA) that will allow community corrections referrals and placements from the 23rd JD for a period of one (1) year from the date of execution of the IGA. All offenders referred for placement by the 23rd JD must be approved for placement by the Arapahoe County Community Corrections Board. The IGA requires the 23rd JD to pay for the placement of offenders sentenced to community corrections and placed in Arapahoe County programs and allows offenders from the 23rd JD placed in Arapahoe County prior to the termination of the IGA to remain in the program until program completion. The IGA requires the 23rd JD to pay Arapahoe County for staff time to train Douglas County staff on the referral process and completion of community corrections program auditing.
