Request for approval of full and final settlement of workers’ compensation claim
end
Purpose and Request:
recommended action
This request seeks the Board’s formal approval of a full and final settlement of a pending workers’ compensation claim filed by County employee, Anthony Vigil.
end
Background and Discussion: Mr. Vigil alleges he sustained a work-related injury on or about June 13, 2023, and initiated a workers’ compensation claim therefrom. The County has been paying benefits on Mr. Vigil’s claim since the claim was initiated, and, with the Board’s prior approval, the parties engaged in settlement negotiations in an attempt to reach a full and final resolution of the claim. The parties were recently able to achieve a full and final settlement of the claim within the parameters previously discussed with the Board.
Alternatives: If the Board rejects the settlement, claimant’s workers’ compensation claim will continue until it is resolved, the County will continue paying benefits on the claim, and the total benefits paid over the remainder of the claim could potentially exceed the amount the parties have agreed to in the settlement.
Fiscal Impact: The County will be required to pay the settlement amount agreed to by the parties that was previously discussed with the Board.
Alignment with Strategic Plan:
☒Be fiscally sustainable
☒Provide essential and mandated service
☒Be community focused
Concurrence: Risk Management concurs with this request.
Resolution: A draft resolution is included.
