The purpose of this resolution is to formally appoint the Board of County Commissioners (BOCC) to serve as the Weed Advisory Board pursuant to Title 35, Article 5.5 of the Colorado Revised Statutes (the "Noxious Weed Act").

Background and Discussion: The Weed Advisory Board is mandated by Colorado Revised Statutes ? 35-5.5-107, which requires counties to establish an advisory body to assist in the development, adoption, and implementation of a noxious weed management plan. The advisory board provides input on priority species for eradication, control, and containment, and advises on effective management practices in coordination with state and local land managers.
Recruitment efforts to solicit resident members for this statutory board has been unsuccessful for several years, meaning the board has been unable to fulfill its advisory function. The Noxious Weed Act allows the Board of County Commissioners to serve directly as the Weed Advisory Board when appointments cannot be filled. By taking this step, the BOCC ensures that the County continues to meet its statutory obligations, provides a mechanism for accountability and oversight, and positions the County to respond effectively to community concerns and land management issues related to invasive and noxious weeds.
