Purpose and Request:

The Board of County Commissioners is requested to adopt a resolution granting the Public Service Company of Colorado (“Xcel Energy”) two easements: 1) an Electric Transmission Line Easement (“ETLE”); and 2) a Temporary Access Easement (“TCE”). These easements are necessary for the construction, completion, and maintenance of electric transmission and distribution lines and related communication facilities relating to the Colorado Power Pathway’s Project (the “Project”).

Alignment with Strategic Plan: Sustainable Growth and Infrastructure - Implement smart growth policies to align housing, transportation, open spaces and economic development.
Background and Discussion: The Board of County Commissioners recently approved a land development application for the Project on June 23, 2026. As part of that approval, transmission lines are to be located within a 150-foot-wide easement, and temporary construction easements are required for access during construction and for operation and maintenance. Xcel Energy is required to obtain all necessary property rights needed for the Project, including without limitation the ETLE and TCE to be located on Arapahoe County-owned property.
Alternatives: There are no appropriate alternatives to what is being recommended for approval.
