Purpose and Request:
recommended action
The purpose of this report is to request the Board adopt a resolution to approve the Uniform Easement Deed and Revocable Storm Drainage License Agreement and authorizing the Director of the Department of Public Works and Development to execute the Agreement on behalf of the County. The Agreement has two functions. First, it conveys drainage easements to the County. Second, it grants the applicant a license to discharge stormwater into the County stormwater system.

Staff has reviewed the Uniform Easement Deed and Revocable Storm Drainage License Agreement and the drainage easement, and has determined that it meets the County's requirements. Staff recommends that the Agreement be approved and easements accepted.

Actions Requested:
1. Approval and acceptance of the Uniform Easement Deed and Revocable Storm Drainage License Agreement for Drainage Easements at Lot 1, Block 1, Dove Valley Business Park Filing No. 11; and
2. Authorize Bryan Weimer, Director, Department of Public Works and Development to execute the specific easement on behalf of the Board.

Background and Discussion: The drainage easement is in the Section 36, Township 5 South, Range 67 West of the 6th Principal Meridian, and is related to the development known as Dove Valley Flex Building (hereinafter referred to as "Administrative Site Plan").

The site lies within the Lone Tree Creek Basin. Existing flows from the site enter the storm water inlets that lead to the Lone Tree Creek. The legal description of the easement property is contained and memorialized in the Uniform Easement Deed and Revocable Storm Drainage License Agreement.
