Purpose and Request:
recommended action
The purpose of this report is to request that the Board adopt a resolution to approve the conveyance by quitclaim deed to CORE Electric Cooperative, the County's interest in Intermountain R.E.A. Drainage Easement, previously recorded at Reception #B8006897, and to authorize the Director of the Department of Public Works and Development to execute the quitclaim deed on behalf of the County.

Staff has reviewed the Quitclaim Deed and recommends approval.

Actions Requested:
1. Approve the conveyance by quitclaim deed of the County's interests in the cited easement; and
2. Authorize the Chair of the Arapahoe Board of County Commissioners to execute the specific deed on behalf of the County.

Alignment with Strategic Plan: Sustainable Growth and Infrastructure - Maximize use of County facilities and assets.

Background and Discussion: The drainage easement is located in the Southwest Quarter of Section 9, Township 9 South, Range 63 West of the Sixth Principal Meridian, County of Arapahoe, State of Colorado and is related to the development known as IREA Brick Center Transmission Line & Substation Project (hereinafter referred to as "Location and Extent").

Engineering Staff has reviewed the Quitclaim deed granted by Core Electric Cooperative with attached legal descriptions. The legal description of the easement property is contained and memorialized in the Quitclaim Deed.
Alternatives: The Existing Drainage Easement to be quit claimed will take off the burden from the county to go inspect facility periodically and also maintain when the owner fails to comply with the maintenance set forth in the Operation and Maintenance Agreement.
