Purpose and Request:

recommended action

The purpose of this request is to obtain authorization for the Chair of the Board of County Commissioners to sign a settlement agreement that has been negotiated in the litigation of Eduardo Barraza v. Arapahoe County Sheriff Tyler Brown, in his official capacity; Civil No. 26-cv-02915-SKC-NRN, a review of which was previously provided to the Board in executive session.

Alignment with Strategic Plan: Economic Resilience and Stability - Support long-term economic resilience through responsible fiscal and investment strategies.                      

 

Background and Discussion: The Barraza claims were a civil lawsuit that was filed on June 29, 2026. An agreement between all parties resolving the need for any litigation has been reached.

 

Alternatives: Allow the case to proceed to trial or continue to negotiate a different resolution.

 

Fiscal Impact: This has been previously discussed with the Board. This settlement agreement will reduce future litigation costs and future potential claims against the County and is offset by other department savings.

Concurrence: The Acting County Attorney has endorsed the proposed agreement.
