Purpose and Request:

recommended action

Staff requests the Board of County Commissioners (BoCC) approve and adopt a resolution to enter into an Intergovernmental Agreement (IGA) with the Southeast Public Improvement Metropolitan District (SPIMD) regarding the SPIMD funding share of the Dry Creek Operational Improvements Project, C20-005.  Specifically, Staff requests the following actions:

 

1.                     Approval of the attached Intergovernmental Agreement between Arapahoe County and SPIMD for Dry Creek Operational Improvements Project, committing SPIMD to the project contribution in the amount of $742,000.00.

 

2.                     Authorization of the BoCC to allow Bryan D. Weimer, Director, to sign the IGA pursuant to Resolution for this BSR.

 

3.                     Authorization to invoice and receive SPIMD reimbursements in accordance with contractual obligations.

 

4.                     Authorization to budget the SPIMD Funds of $742,000.00 into Cost Center 424520020-54896 (Expense) and recognize the anticipated revenue of $742,000.00 into Cost Center 424520020-43129 per the IGA.

 

The Dry Creek Operational Improvements project converts the eastbound right-only lane to a through-right lane that continues east to the Inverness Drive East intersection.  Instead of an eastbound right turn lane, drivers could use the lane to continue through the intersection before merging at the Inverness Drive East intersection, approximately 1,500 feet further east.  The vast majority of the traffic turning right from the Northbound I-25 off-ramp are continuing east on Dry Creek Road past the Clinton Street/ Inverness Drive West intersection.  A new eastbound right turn lane will be added at Inverness Drive West.

 

The project also includes the addition of a new westbound left turn lane to Dry Creek Light Rail Transit Station, sidewalk improvements along the south side of Dry Creek Road, signage and pavement markings.

 

This project will improve operational performance, improve vehicular safety and reduce congestion with less weaving maneuvers along Dry Creek Road between I-25 and Inverness Drive West.

Background and Discussion: Dry Creek Road is an important transportation corridor serving the growing business, commercial, and residential areas east and west of the I-25 corridor.  Transportation improvements are needed along the corridor to address operations, safety, and local accessibility.  Efficient access to/from I-25 is critical to the economic activity centers and residential areas surrounding the freeway in Arapahoe County and the City of Centennial.  The I-25/Dry Creek Road interchange is an important connection to the regional transit links served by the Dry Creek Station. 

 

Traffic operations are congested along eastbound Dry Creek Road, particularly during the AM and PM peak periods, with low average travel speeds, poor levels of service, and long vehicle queues approaching the signalized intersections east of I-25.  INRIX speed data for the Dry Creek Road corridor east of I-25 shows that over the last four years speeds in both directions have fallen dramatically with average speeds below 20 mph spreading beyond the peak hours and occurring throughout the day.

 

Substantial eastbound traffic weaving maneuvers occur in the short segment of Dry Creek Road between the northbound I-25 off-ramp and the Clinton Street/ Inverness Drive West intersection.  The eastbound lane drop at Inverness Drive West contributes to abrupt lane changes and weaving for drivers continuing east on Dry Creek Road.

 

Arapahoe County collaborated with CDOT, City of Centennial, and the Denver South TMA on the I-25/Dry Creek Road Interchange and Corridor Study, completed in 2016, and continues to work with agency stakeholders to prepare for the implementation of improvements recommended by the study, beginning with this project. 

 

The 2020-2023 Transportation Improvement Program (TIP) identifies federal and state-funded transportation projects to be implemented in the Denver region from fiscal years 2020 through 2023.  This project was submitted by the County for federal funding through the Arapahoe County Transportation Forum and ultimately selected and approved by DRCOG to be included in the 2020-2023 TIP.

The County is working on separate IGAs with each contributing entity/ jurisdiction.  These funding partners include Southeast Public Improvement Metropolitan District, Inverness Metropolitan District (Inverness), the City of Centennial (Centennial), and the Colorado Department of Transportation.  Once all IGAs are finalized the County will begin scoping the project and issuing a Request for Proposal for design of the project.  The Final Design for the project has been estimated at $719,000 as shown in the table below under 2020 funding.  After the design phase is completed, the project will be moved to the construction phase with the advertisement of the project for construction services.  The Transportation Division Staff will be managing the project through all phases.

 

Fiscal Impact: The table below details the funding partners for this project.

 

 

There is NO necessary County funding for this action.  For the purposes of tracking the reimbursements of funds from SPIMD associated with this IGA, Staff has created new cost center and two accounts within the cost center which are as follows:

The SPIMD share of $742,000 will be recognized as revenue and appropriated into an expenditure cost center for the County to use on the project.  The expenditures from this account will be reimbursed accordingly and any remaining funds in this the revenue account will be returned to SPIMD after completion of the project per the requirements of the IGA.

 

The IGA established that SPIMD will be contributing $742,000.00 to this project.  SPIMD will reimburse the County based on monthly draws from the SPIMD Project Fund for its pro-rata share of the monthly Actual Project Costs. 

 

Once consultant invoices are provided to the County, County Staff will review and forward onto SPIMD for verification of applicable costs and issue a check to the County, which will be placed in the cost center referenced above.  The County will pay the invoices using a combination of County, City of Centennial, Federal, Inverness Metro District and SPIMD funds.  Once the payment is received from SPIMD, the funds shall be deposited in the project’s revenue account.  The cost centers WILL NOT accrue interest. 

 

Alternatives: Staff recommends that the IGA be approved.  The alternatives to approval of the IGA would be for the BoCC to not approve the IGA with SPIMD, which would put the project in jeopardy because the local match to the federal funding for the project would not fully be available and have to be assumed by the other local funding partners for execution of the project.

Staff Recommendation: Staff recommends approval of the IGA between SPIMD and the County for the Dry Creek Operational Improvements Project. 

 

Concurrence: The Public Works and Development Department and SPIMD have reviewed the project funding and are in agreement with this proposal and the IGA.  The Arapahoe County Attorney’s office has reviewed the IGA and has no further comments.

This action also authorizes the budgeting of the anticipated SPIMD Funds of $742,000 into Cost Center 424520020 - 54896 (expense) and 424520020-43127 (revenue).
