Purpose and Request:

recommended action

The purpose of this report is to request the Board approve a Quitclaim Deed for 17’ of right-of-way which was dedicated to Arapahoe County.  The right-of-way is adjacent to 80’ of existing right-of-way belonging to the Town of Bennett. Therefore, the County has no interest or need for the right-of-way as it is not of practical use.  The Public Works and Development staff recommends approval of the Quitclaim deed.

Background and Discussion: Arapahoe County accepted 17’ of right-of-way on the east side of North Kiowa-Bennett Road that was dedicated by the Muegge Farms Subdivision Plat.  The right-of-way which was dedicated to Arapahoe County is adjacent to the remainder of N Kiowa-Bennett Rd (80’ of right-of-way) which is already owned and maintained by the Town of Bennett. Because of this, Staff finds it appropriate to approve the Quitclaim deed to the Town of Bennett.

 

Alternatives: The board could deny the Quitclaim deed request and retain the 17’ of right-of-way along North Kiowa-Bennett Road. 

 

Fiscal Impact: There is no fiscal impact related to this request

                     Be community focused

 

Concurrence: This request was reviewed by the Public Works and Development and County Attorney’s office and both department support the request to approve the Quitclaim deed.
