Purpose and Request:

The Havana Water and Sanitation District requests the Board of County Commissioners set a public hearing date of November 9, 2021 for consideration of the SD21-003 Havana Water and Sanitation District Service Plan Amendment. Planning staff recommends approval of this request, which complies with the statutory process for metropolitan district service plans.

Background and Discussion: Colorado Statute CRS 32-1-202(1)(a) outlines the process for reviewing and approving metropolitan district service plans. After a service plan has been filed with the County Clerk and Recorder, the Planning Commission must make a recommendation regarding the plan. At the first BoCC meeting that is at least ten days after the Planning Commission Action, the BoCC must set a public hearing date for BoCC review of the service plan. On October 19, 2021, the Arapahoe County Planning Commission voted to recommend approval of the Havana Water and Sanitation District Service Plan Amendment. Staff has reviewed the SD21-003 application and finds it is ready for the Board of County Commissioners consideration at a public hearing. Staff concurs with the applicant’s request to set a hearing date for November 9, 2021. 

Alternatives: The Board of County Commissioners has alternatives that include the following:   1. Approve the request for a November 9, 2021 hearing.  2. Continue to a date certain for more information.  3. Deny the request.

Staff does not recommend continuing or denying this item. Those options would not meet statutory requirements for evaluating a metropolitan district service plan.

Concurrence: On October 19, 2021, Planning Commission voted to recommend approval of the service plan to the Board of County Commissioners. The proposed amendments have been reviewed by County staff, including the County Attorney’s office.
