The Board is requested to review and agree upon the proposed Arapahoe County Public Health Body Art Regulations and set a public hearing for final adoption as early as October 12, 2022.

Background and Discussion: The proposed Arapahoe County Public Health Department Body Art Regulations describe the rules and regulations for the safe and sanitary practice of performing body art, the safe and sanitary physical environment where body art is performed, and the safe and sanitary conditions of equipment utilized in body art procedure in Arapahoe County. The proposed regulation may be promulgated pursuant to 25-04-2101, et seq. C.R.S. and the regulation is required to be no less stringent than the Colorado Department of Public Health and Environment’s (CDPHE) Body Art Regulations 6 CCR 1010-22. The purpose of the proposed Regulations is to provide guidance and establish standards for the safe and sanitary operation of body art and are applicable to any person wishing to perform commercial body art in Arapahoe County.
The proposed regulation is based on the most recent regulation developed by Tri-County Health Department (TCHD), Regulation BA-16, which was approved by CDPHE, and adopted by the TCHD Board of Health August 9, 2016. We are now proposing that Arapahoe County Board of Health adopt this most recent version of BA-16, which has been revised specifically for Arapahoe County to remove all references to Adams and Douglas County, included grammatical and formatting revisions without sacrificing the original intent or substance of the regulation.
We request the Board to agree on the proposed regulation and hold a public hearing for final adoption as early as October 12, 2022.

Alternatives: The Board could choose to make changes to the recommended draft regulation (contingent upon CDPHE approval) or reject the recommended draft regulation in favor of the state regulation 6 CCR 1010-22
