The purpose of this General Business Item is to consider the adoption of proposed Arapahoe County Ordinance No. 2022-01 Establishing the Operation of Limited Commercial Marijuana Stores within Unincorporated Arapahoe County.

Background and Discussion:

Proposed Ordinance No. 2022-01 (attached) is being presented for adoption. A first reading of this Ordinance was held on October 25, 2022, the text of the Ordinance was published in full in the Colorado Community newspapers on October 27, 2022, in conformance with statutory requirements.

 

The Ordinance will allow the current four (4) licensed commercial marijuana store locations in unincorporated Arapahoe County the ability to relocate and or increase in size subject to the restrictions contained in this Ordinance, the provision of the Arapahoe County Land Development Code Sec. 3-3.5 Marijuana Land Use, and subject to State limitations.

 

After adoption of the Ordinance, the Ordinance will be published by title only and include any part of the Ordinance that was amended following the initial publication and include the date of the initial publication. The Ordinance will take effect upon thirty (30) days after publication of the adopted Ordinance.

 

Fiscal Impact: If the Board decides to enact the proposed Ordinance No. 2022-01, the Board will receive fees for the relocation applications for the commercial marijuana store licenses.

 

Alternatives: The Board could elect to not proceed with the adoption of Ordinance No. 2022-01 and either postpone the second reading or decide not to move forward with the proposed Ordinance. If the Board decides not to move forward with the proposed Ordinance No. 2022-01, Ordinance No. 2020-02 would remain in effect.
