The Board of County Commissioners is requested to authorize the Chair to sign the Colorado Department of Early Childhood SFY2023 Child Care Assistance Program (CCCAP) Memorandum of Understanding with the Colorado Department of Early Childhood (CDEC) and approve the Human Services Director to sign the annual amendment for the term of the MOU.

Background and Discussion: Colorado Revised Statute (C.R.S.) 26.5-4-115 requires the Colorado Department of Early Childhood (CDEC) to enter into an annual performance contract with each county to identify its duties and responsibilities in implementing the Colorado /TANF Program and the Colorado Child Care Assistance Program (CCCAP). The BOCC had approved a previous version of the MOU on June 14, 2021 which was for 3 years, but with the creation of the Colorado Department of Early Childhood, the CCCAP portion of the MOU was removed, requiring a new MOU for the Colorado Works/TANF Program. The separate CCCAP MOU is now being finalized.
County Commissioners, County Attorneys and County Human Services Directors have previously met with CDHS officials to reach an agreement on the language for the Colorado Child Care Assistance MOU. The agreement has been reached and the MOU is ready for BOCC signature. This MOU is between Arapahoe County and the Colorado State Department of Early Childhood (CDEC) for the term from January 1, 2023 through June 30, 2025 and identifies the County’s duties and responsibilities in implementing the Colorado Child Care Assistance Program. The MOU must be reaffirmed annually through an amendment signed by both parties, which is why the Human Services Department is also requesting approval for the Human Services Director to sign the annual amendment for the term of the MOU.
Overall, the changes to this MOU are merely technical changes and the terms of the MOU remain legally and practically the same. The previous MOU expiring June 30, 2021, was extensively rewritten in a collaborative process between the State and counties prior to signature in 2018. Due to those efforts, and due to the separation of the CCCAP portion of the prior MOU from the Colorado Works/TANF portion of the prior MOU, only minor, technical clean-up changes were made.
