Open Spaces requests approval of the Board of County Commissioners to grant a drainage easement to the Town of Bennett on the Kiowa Creek Open Space property.

Background and Discussion: The Town of Bennett is proceeding with its County Road 137 and Colorado State Highway 36 Kiowa-Bennett Road Drainage Improvement Project, which will provide improved drainage along State Highway 36 and at the intersection of County Road 137 (Kiowa-Bennett Road). This project will improve local drainage, minimize flooding risk, and provide washout protection for both roads.

The Town has requested that Open Spaces grant a non-exclusive easement to the Town to construct and maintain certain drainage improvements for the project on approximately one quarter-acre of land on the west side of Kiowa-Bennett Road on the Kiowa Creek Open Space property. The improvements will facilitate water conveyance, detention, and retention after storm drainage flows under Kiowa-Bennett Road from the east side to the open space property on the west side. The Town will pay $1,660 to the County for the benefit of the easement.

Under the terms of the easement, the Town will be responsible for maintenance of its improvements and for the removal of trash, equipment, and anything else that could impede their proper functioning, such as debris, grasses, weeds, and sediment. Furthermore, the Town will be responsible for restoration if it causes any damage to the open space property.
